Illinois HB 3773: The Second U.S. State to Regulate AI Hiring
Illinois HB 3773 took effect January 1, 2026, amending the Illinois Human Rights Act. Employers using artificial intelligence to make hiring or promotion decisions for Illinois-based candidates face two core obligations:
- Notice: Candidates must be told an AI tool is being used and which characteristics it evaluates.
- Nondiscrimination: AI-assisted decisions may not discriminate on protected grounds, and employers are liable for AI-driven adverse impact.
Unlike NYC's Local Law 144 — which requires a specific, annual, independent bias audit with a publicly posted summary — HB 3773 is notice-and-liability based. The practical consequence: employers operating in both states need a compliance package that covers two different regimes. NYC requires the statistical audit; Illinois requires the disclosure framework around the same tool.
ComplyLens audits are built to cover the NYC audit requirement today, with the Illinois notice section ready as multi-state packages roll out. One data upload, one statistical analysis, reports for each jurisdiction.
